Marital Property Agreements

Bring Clarity to How Property and Finances Are Handled in Your Relationship

Protect Your Financial Future

Marital property agreements allow couples to define how they want to handle ownership and profits of their assets, debts, and financial responsibilities, protect individual interests and provide clarity in the relationship. These agreements must be in writing and signed by both parties to be valid, offering security beyond Texas’s default community property laws, which consider most property acquired during marriage as jointly owned.

Marital property agreements are most effective when they are created proactively, at a time when both parties are aligned and communicating openly. Addressing these issues early allows couples to make thoughtful, intentional decisions without the pressure or expense that can arise if questions are left unresolved. By customizing an agreement, couples can reflect their intentions and adapt to their unique circumstances, creating peace of mind and confidence in their financial future.

From Austin to Dallas and Houston, and everywhere in between, we provide expert support so you can confidently plan your financial future together.

Strong Legal Foundations for Your Texas Marital Agreement

We ensure your marital property agreement meet Texas requirements, is fair, and stands up in court. Every agreement is voluntary, transparent, and carefully crafted to reflect your financial situation and goals.

What It Can and Cannot Cover

While agreements can protect assets and clarify financial responsibilities, they cannot determine child support, custody, or violate public policy. We make sure your agreement avoids these pitfalls.

Our Approach: Clear, Compassionate, Tailored

We guide couples through sensitive conversations with clarity and respect, explaining every provision in plain language. Each agreement is personalized to your unique circumstances—protecting business interests, family inheritances, or financial clarity—without unnecessary complexity.

How it works?

Step 01: Get in Touch

To get started, fill out our online contact form to briefly tell us about your situation. Our intake coordinator will review your submission and send you the appropriate questionnaire to complete.

Step 02: Submit the Questionnaire

Once you’ve completed the questionnaire, our intake coordinator will use that information to match you with the right attorney on our team and reach out to schedule your consultation.

Step 03: Schedule a Consultation

Our intake coordinator will coordinate a free or paid consultation, depending on your situation. During this call, you’ll have the opportunity to get your initial questions answered and learn more about what the process might look like. If you choose to move forward, we’ll send along a contract and request any relevant documentation we need from you.

Step 04: Connect With an Attorney

You’ll meet with your attorney virtually or at our Austin office to go over your situation in depth. Together, you’ll discuss your goals, your assets, your family’s needs, and any particular concerns — from minor children and special needs beneficiaries to tax considerations. Your attorney will walk you through your options and help you decide which tools (wills, trusts, powers of attorney, etc.) are right for your plan.

Step 05: Drafting Your Plan

Our team gets to work preparing your estate planning documents. We’ll keep you informed throughout and may follow up with clarifying questions to make sure every detail reflects your wishes accurately.

Step 06: Review and Sign

Once your documents are ready, you’ll review everything with your attorney, ask any final questions, and sign. You’ll leave knowing your people and your assets are taken care of.

Build Trust and Confidence Together

In many cases, the agreement is never needed—but having clear terms in place provides reassurance, reduces uncertainty, and allows couples to focus on building their life together, knowing their financial expectations are clearly understood and documented. We ensure your marital property agreement meets Texas requirements and could withstand a legal battle. To do so, we ensure every agreement is voluntary, transparent, and carefully crafted to reflect your financial situation and goals.

Creating a marital property agreement is an act of respect and transparency. It strengthens relationships by addressing finances openly, ensuring fairness, and protecting your future. At Hardie Alcozer, we guide couples across Texas with expertise, warmth, and personalized solutions, helping your agreement reflect your unique partnership today and tomorrow.
